A Pebble Beach man scheduled to be released from prison on Sunday after serving nine years for rape won’t be released pending the outcome of a petition filed by prosecutors to have Tom Pollacci designated a ‘sexually violent predator.’“It is to ensure the safety of the public and that individuals who are at risk committing more violent offenses against the public that they receive treatment and that that treatment is in a secure facility,” said prosecutor Christina Johnson.Pollacci appeared in a Salinas courtroom Friday via zoom at which time he was supposed to be arraigned on the petition.Pollacci appeared to have no idea prosecutors were planning to pursue the ‘sexually violent predator designation.“What is this for exactly?” Pollacci said via zoom.The public defender said he would explain to Pollacci in person.In 2010 Pollacci was convicted of raping a woman in a loft of the family's Pacific Grove liquor store. A year later he pleaded guilty to raping a woman in a travel trailer just as the case was about to head to trialIn that case, prosecutors intended to seek life in prison if convicted and they planned to present at least seven women who Pollacci allegedly sexually assaulted.In reports from two psychologists who recently evaluated Pollacci, they believe the sex offender is likely to re-offend if released from prison.“They concluded that he does qualify for sexually violent predator proceeding and that is why we filed the petition,” said Johnson. At that trial, a jury or judge will determine whether Pollacci should be designated a ‘sexually violent predator’ and committed to Coalinga state mental hospital for treatment. How long Pollacci remains there really depends on him. “It really varies because it just depends on the individual and their response to treatment if they participate in treatment,” said Johnson. But Pollacci's case is moving forward as another ‘sexually violent predator’ Jorge Rubio is set to be released from Coalinga state hospital.The judge in that case Mark Hood has raised questions regarding Rubio’s possible placement in Bradly as outrage is being raised by neighbors.“These are complicated cases they can take a lot of time and there's definitely public opinion strong public opinion about these cases,” said Johnson.Rubio will be back in court on June 24 for a status hearing.Pollacci is due back in court June 23 for further arraignment on the petition.
